Do we use "Cookies"?

Yes. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your Web browser (if you allow) that enables the site's or service provider's systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current Site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about Site traffic and site interaction so that we can offer better Site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our Site visitors and to serve advertisements on our behalf on the internet. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser (like Firefox or Google Chrome) settings. Each browser is a little different, so look at your browser Help menu to learn the correct way to modify your cookies. If you turn cookies off, you won't have access to many features that make your Site experience more efficient and some of our services will not function properly.

How do we use your information?

We may use the information we collect from you when you purchase products, enter a contest or promotion, respond to marketing communication, browse the Site, or use certain other Site features in the following ways:

  • To improve our services to you.
  • To respond to your inquiries related to support, or other requests, and to send promotional emails to those that request or authorize them.
  • To conduct internet advertising through third party providers.
  • To track your purchase history and to contact you for account and promotional purposes.
  • To detect and prevent fraud, to collect amounts owing to us and to maintain business records.

How do we protect visitor information?

We realize that our customers trust us to protect their Personal Data. We implement a variety of security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. When you place orders or access your personal information, we offer the use of a secure server. All sensitive information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be only accessed as stated above. Credit card payment is processed through Shopify Pay. All credit card information is stored and encrypted in Shopify Pay’s PCI compliant server. For more information visit the Shopify Pay website here. While we attempt to protect the information in our possession, no security system is perfect, and we cannot promise that information about you will remain secure in all circumstances.

Do we disclose the information we collect to third parties?
We do not sell, trade, or otherwise transfer to third parties your Personal Data unless we provide you with advance notice, except as otherwise described below. The term "third parties" does not include our business. It also does not include website hosting partners and other parties who assist us in operating our Site (i.e., currently, our platform is “powered by” Shopify to analyze data, process transactions, and payments, and fulfill orders), conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our Site policies, or protect ours or others' rights, property, or safety.

Third Party Tracking Companies. We share your cookies, IP address and Device ID. These third parties may also collect information directly from you as described in this Privacy Policy. The privacy policy of these third-party companies applies to their collection, use and disclosure of your information. For example, we use a tool called “Google Analytics” to collect information about use of our Sites. Google Analytics collects information such as how often users visit the Sites, what pages they visit when they visit, and what other sites they used prior to coming to our Sites. We use the information we get from Google Analytics only to improve the Site. Google Analytics collects only the IP address assigned to you on the date you visit this site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with Personal Data. Although Google Analytics places a permanent cookie on your web browser to identify you as a unique user the next time you visit this site, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to the Site is restricted by the Google Analytics Terms of Use (www.google.com/analytics/tos.html) and the Google Privacy Policy (www.google.com/privacypolicy.html). You can prevent Google Analytics from recognizing you on return visits to this Site by disabling cookies on your browser. For more information about how Google uses data when you use the Sites, you can visit: www.google.com/policies/privacy/partners/.

Social Networks. If you use any features made available to you on our Site by a third party (i.e, Instagram, Pinterest, Facebook, Twitter) it may result in information being collected or shared between us and the third party. For example, if you use Facebook’s “Like” feature, Facebook may register the fact that you “liked” a product and may post that information on Facebook.

Other Third-Party Service Providers. We may share your Personal Data with companies that perform services for us, such as fulfilling orders, delivering packages, sending postal mail and e-mails, analyzing customer data, providing marketing assistance, processing credit card payments, investigating fraudulent activity, conducting customer surveys, and providing customer service. We share e-mail activity data with MailChimp to help us with automated e-mail deployments to consumers for order confirmations, status updates, abandoned cart emails or product review survey emails. We also work with Yotpo to deploy automatic product review requests. While Yotpo and Mailchimp have a license from us to use e-mail addresses and e-mail activity data in their applications, these applications do not share e-mail addresses or any specific e-mail activity data with other third parties that are not our service providers.

If you do not want third parties who collect information about your use of our Site or to tailor any of the advertising that you see, you can opt-out at the Digital Advertising Alliance in the US, the Digital Advertising Alliance of Canada in Canada, or the European Digital Advertising Alliance in Europe.
  • Effect Of Opting Out Of Behavioral Advertising. Please note that opting-out of behavioral advertising does not mean that you will not receive advertising while visiting our Site. • Changes To Your Personal Data. P.F. Candle Co. relies on you to update and correct your Personal Data. You can modify or delete your profile within your registered account. Please note that P.F. Candle Co. may keep historical information and content in our backup files and archives as permitted by law and to the extent we anticipate that the information may be required in connection with the original purpose of the collection, or as otherwise permitted or required by law or our legitimate interest to comply with foreign law.
  • Deletion Of Your Personal Data. Typically, we retain your Personal Data for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required for the operation of purchase transaction or permitted by law or our legitimate interest to comply with foreign law. You can, however, request that we delete your Personal Data. All requests must be directed to the contact in the “Contact Us” section below. We can also decide to delete your data at any time if we believe that the data is incomplete, inaccurate, or that our continued use and storage are contrary to our obligations to other individuals or third parties. In addition, we may keep your Personal Data and usage history as needed to comply with our legal obligations, resolve disputes, and/or enforce any of our agreements.
  • Revocation Of Consent. If you revoke your consent for the processing of Personal Data, in accordance with this Privacy Policy, then you must discontinue all use of our Site and delete any accounts that you created. In some cases, we may limit or deny your request if the law permits or requires us to do so, or if we are unable to adequately verify your identity.

CCPA Rights

Your CCPA rights are described below. You can make a Request to Know or a Request to Delete under the CCPA by submitting a Privacy Request at the top of this page, or by clicking here. Alternatively, you can make a request by calling us toll-free at (855) 931-2906.

Right to Know

You have the right to request to know the following about the personal information we have collected about you in the past 12 months:

  • the categories and specific pieces of personal information we have collected about you
  • the categories of sources from which we collect personal information about you
  • the business and commercial purposes for which we collect personal information
  • the categories of third parties with whom we share the information
  • the categories of personal information about you that we disclosed for a business purpose, and the categories of third parties to whom we disclosed that information for a business purpose

If you make a Request to Know more than twice in a 12-month period, we may require you to pay a small fee for this service.

Right to Delete

You have the right to request that we delete any personal information about you that you have provided to us. We will permanently delete from our records any personal information that is not necessary for our business operations and direct our service providers to do the same.

We consider information to be necessary for our business operations if it is used to:

  • Complete an obligation to you that you have requested
  • Detect and resolve issues related to security or functionality
  • Comply with legal obligations

Right to Non-Discrimination

If you exercise your CCPA consumer rights:

  • We will not deny goods or services to you
  • We will not charge you different prices or rates for goods or services, including through the use of discounts or other benefits or penalties
  • We will not provide a different level or quality of goods or services to you

Right to Opt-Out

You have the right to opt-out of the sale of your personal information.

You may opt-out of the "sale" of your information here.

Request Verification

Before we can respond to any CCPA requests, we will need to verify that you are the consumer who is the subject of the CCPA request. Verification is important for preventing fraudulent requests and identity theft.

The verification process depends on which type of request you make and how you make it. Typically, identity verification will require you to confirm certain information about yourself based on information we have already collected. For example, we will ask you to verify that you have access to the email address we have on file for you. If we cannot verify your identity based on our records, we cannot fulfill your CCPA request.

For a request that seeks specific personal information, we ask that you sign a declaration stating that you are the consumer whose personal information is the subject of the request, as required by the CCPA.

In some cases, we may have no reasonable method by which we can verify a consumer's identity. For example:

  • If a consumer submits a request but we have not collected any personal information about that consumer, we cannot verify the request.
  • If the only data we have collected about a consumer is gathered through website cookies (i.e., the consumer visited our website but had no other interaction with us), we are unable to reasonably associate a requester with any data collected; therefore, we cannot verify the request.

Authorized Agent

A California resident's authorized agent may submit a Request to Know or a Request to Delete under the CCPA by emailing us at privacy@pfcandleco.com. Requests submitted by an authorized agent will still require verification of the person who is the subject of the request in accordance with the process described above. We will also ask for proof that the person who is the subject of the request authorized an agent to submit a privacy request on their behalf. An authorized agent that has power of attorney pursuant to California Probate Code section 4121 to 4130 must submit proof of statutory power of attorney, but consumer verification is not required.
